In January 1842, presumably at ’s request, Elliot Roberts, clerk of the Circuit Court in , made certified transcripts of the proceedings in the two 1839 lawsuits. Given that the Caldwell County Courthouse and all original court records were destroyed by fire in 1860, few if any of JS’s original legal papers produced by the Caldwell County Circuit Court are extant.
This document was in ’s possession and presumably was retained by his descendants for an unknown time upon his death. In 1953, it was one of several miscellaneous Boosinger papers in the possession of M. S. MacCarthy of Glendale, California. Sometime between 1953 and 1958, the Boosinger papers were transferred from M. S. MacCarthy to Mrs. H. W. Deegan. In 1958, Deegan sold the Boosinger papers to the Huntington Library, San Marino, California.

I sole Judge of the fifth Judicial Circuit of the state of composed of the counties of , , , and Carroll do certify that Elliott Roberts whose name and attestation is affixed to the foregoing certificate was at the time of making the <same> Clerk of the Caldwel[l] Circuit Court (it being a court of Record) duly commissioned and qualified as such, and that his said certificate is in due form of law.
